Terms of Service

SpottedNYC is an independent, third-party informational service. We are not affiliated with, endorsed by, or in any way officially connected with StreetEasy, Zillow Group, the New York City Department of Buildings (DOB), the New York City Department of Housing Preservation and Development (HPD), or any other government agency or real-estate platform.

Our Services are provided on a "Beta" basis, meaning features, data, and availability may change at any time without notice.

You must be at least 13 years old to use our Services. By using the Services you represent and warrant that you meet this requirement.

Data is provided "as is" without warranty of accuracy, completeness, or timeliness. Specifically:

• Building violation records are sourced from public government databases (NYC DOB, NYC HPD). Government records may be delayed, contain errors, or not yet reflect recently resolved or newly filed violations. SpottedNYC does not independently verify this data.
• Market-price estimates and rent comparisons are statistical summaries derived from aggregated listing data and generated algorithmically from publicly available sources. They represent general market trends, not valuations or appraisals, and do not account for individual unit condition, lease terms, landlord concessions, renovation history, or other factors known only to the parties in a transaction. Market estimates may contain errors and should not be relied upon for negotiation, financing, or any financial decision. They should not be used as the sole basis for any financial decision.
• Building profiles (owner name, building class, unit count, year built, etc.) are sourced from public city records, which may be outdated or contain clerical errors.
• Address matching is performed using probabilistic algorithms and may occasionally misidentify buildings, particularly for corner lots or buildings with multiple addresses.

SpottedNYC is not liable for any decisions made in reliance on information displayed through the Services. See Section 9 (Limitation of Liability) for the full scope of our liability disclaimers.

The SpottedNYC Chrome Extension operates on third-party websites (currently StreetEasy). You are solely responsible for ensuring your use of the Extension complies with the terms of service of any third-party website on which you choose to run it. SpottedNYC is not responsible for any consequences arising from your use of the Extension on third-party platforms.

The Extension reads publicly visible listing data from the current browser tab solely to perform building lookups. It does not modify the content of third-party websites in a way that misrepresents that website's information; it overlays supplemental data in a clearly branded SpottedNYC widget.

SpottedNYC is committed to complying with the federal Fair Housing Act and all applicable state and local fair housing laws. Our Services provide factual, public data about buildings — including violations and market pricing — and are not intended to, and must not be used to, discriminate against any person based on race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected by law.

SpottedNYC does not provide neighbourhood-level information about the demographic composition of residents, schools, or other factors that could facilitate unlawful housing discrimination.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

• Scrape, copy, or systematically download data from SpottedNYC for commercial redistribution without our written permission.
• Use the Services to build a competing product or service that incorporates our data or architecture.
• Attempt to reverse-engineer, decompile, or extract proprietary algorithms or data pipelines.
• Interfere with or disrupt the integrity or performance of our Services.
• Transmit any material that is unlawful, harmful, defamatory, or otherwise objectionable.

All original content, design, code, and branding on SpottedNYC (including the name, logo, and visual design) are the property of SpottedNYC and are protected by applicable intellectual property laws. Data sourced from government databases remains in the public domain as required by law.

You are granted a limited, non-exclusive, non-transferable licence to use the Services for personal, non-commercial purposes only.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SPOTTEDNYC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES AS TO THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY DATA OR CONTENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SPOTTEDNYC AND ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY — ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF SPOTTEDNYC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You agree to indemnify, defend, and hold harmless SpottedNYC and its founders, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

The Services may contain links to third-party websites or integrate third-party APIs (e.g., Google Maps). These links are provided for convenience only. SpottedNYC does not endorse and is not responsible for the content, privacy practices, or terms of any third-party service. Your interactions with third-party services are governed solely by their terms and policies.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice. We may also update these Terms at any time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law provisions. Any dispute arising from or relating to these Terms or the Services shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
